A federal judge in Georgia has stepped aside from a high-profile election case following the Trump administration’s Justice Department request that she be removed due to concerns about her impartiality.
U.S. District Judge Eleanor Ross filed a recusal order Monday without detailed explanation, stating only that stepping aside was appropriate “in the interest of justice.” The case will now be reassigned through the Northern District of Georgia’s standard random selection process.
The Justice Department had argued Ross could not fairly oversee the litigation because of her prior professional affiliations and attendance at a political event connected to Fulton County District Attorney Fani Willis, who brought the original election-related charges.
Misconduct Investigation Background
Ross faced separate scrutiny over a judicial misconduct investigation that became public earlier this year. The inquiry found Ross engaged in an inappropriate sexual relationship with a police officer inside her chambers and attended a partisan political event.
The investigation also found Ross initially denied allegations during questioning, though she later acknowledged the relationship. Ross received a private reprimand following the investigation, which was initiated after a law clerk reported concerns about her conduct.
Investigators determined Ross attended a victory celebration connected to Willis, whose election-related prosecutions became one of the most politically charged legal battles in the country.
Legal Standards and Next Steps
The Justice Department sought Ross’s removal under 28 U.S.C. § 455, a federal statute requiring judges to step aside when their impartiality might reasonably be questioned. Because Ross recused herself voluntarily, the court never ruled on whether removal was legally required.
Federal recusal standards do not require proof of an actual conflict of interest, but instead focus on whether a reasonable person could question a judge’s impartiality based on circumstances. The clerk’s office is expected to assign a replacement judge in the coming days.
Defense Response and Implications
Defense attorneys opposed the Justice Department’s effort to remove Ross, arguing the reassignment would delay proceedings and unfairly burden defendants. One attorney said the recusal “raises serious concerns about whether the Justice Department is using ethics rules as a tool to manipulate case assignments.”
A White House spokesperson said the recusal “vindicates the President’s commitment to ensuring that election cases are heard by impartial judges who follow the law, not their personal politics.” The reassignment is expected to slow proceedings as a new judge reviews the extensive record already developed.
