A Department of Justice official has suggested that former First Lady Jill Biden could potentially face criminal charges in connection with former President Joe Biden’s delayed prostate cancer diagnosis.
Leo Terrell, a senior counselor to the Assistant Attorney General for Civil Rights and former Fox News contributor, made the suggestion Monday in response to Sunday’s announcement that Joe Biden was diagnosed with an aggressive form of prostate cancer that has spread to his bones. Terrell reposted a conservative social media message with the comment “Elder Abuse! Criminal Charges??”
The diagnosis announcement has prompted medical experts to question how the cancer went undetected for an extended period. Several physicians expressed surprise that routine prostate screenings recommended for men over 50 did not catch the disease earlier.
Medical Experts Weigh In
Dr. Steven Quay, cited by Donald Trump Jr., called prostate cancer “the easiest cancer to diagnose when it first starts,” noting that routine blood tests would have revealed the condition’s progression. Dr. Howie Forman of Yale University wrote that “it is inconceivable that this was not being followed” during Biden’s presidency.
Dr. Marc Siegel, Fox News senior medical analyst, stated on Sunday that “a lot of times, we find an elevation in prostate-specific antigen” before pursuing further testing. He noted testing all male patients over 45 and said he was “a little taken aback” at how advanced Biden’s cancer had become.
Dr. Vin Gupta, an NBC News medical contributor, pointed out that Presidents Donald Trump, Barack Obama, and George W. Bush all have documented records of prostate examinations. However, no such record exists for Biden, and his past medical records remain inaccessible to the public.
The Announcement
Biden’s office released a statement Friday disclosing the diagnosis, noting he was examined for a prostate nodule after experiencing increasing urinary symptoms. The statement indicated the cancer has a Gleason score of 9 (Grade Group 5) with bone metastasis but is hormone-sensitive and manageable.

President Donald Trump stated on Monday that “somebody is not telling the facts” regarding the diagnosis timing and disclosure.
